PUJA Academy & Lee Hishammuddin Allen & Gledhill Host Seminar on “Maximizing Success Under the Construction Industry Payment and Adjudication Act 2012”

Bandar Seri Begawan, 8 August 2024 – PUJA Academy Sdn Bhd (PASB) in collaboration with Lee Hishammuddin Allen & Gledhill, Malaysia (LHAG) successfully conducted a seminar entitled “Construction Industry Payment and Adjudication Act 2012: Maximising the Chances of Success in 100 Working Days” on August 8, 2024. The seminar was led by Mr. Darshendev Singh, a distinguished international lawyer, arbitrator and adjudicator with extensive experience in international and domestic arbitration, litigation, mediation, and adjudication.
The seminar was an awareness session on the Malaysian Construction Industry Payment and Adjudication Act 2012 (CIPAA). The seminar addressed the primary challenges faced by the construction industry with regards to delayed payments by Clients, and the purpose of the Construction Industry Payment and Adjudication Act 2012 in resolving payment disputes effectively. CIPAA is a legislation which came into force in Malaysia about 10 years ago and is a game changer for their construction industry by alleviating cash flow issues. As with all businesses, apart from profitability, cash flow is a critical factor for the long term-sustainability of businesses.
Mr. Singh provided a comprehensive overview of adjudication procedures, focusing on the proper implementation and management of these processes. He also discussed the professional advantages of serving as an adjudicator.
The seminar fostered an interactive environment, encouraging active participation and critical discussions. Participants had the opportunity to engage in discussions and how CIPAA has helped enhance the Malaysian Construction Industry through fair and expeditious adjudication of delayed payment disputes.
The session was well-attended, with over 40 participants, including PUJA members, government officers from the Brunei Darussalam Arbitration Centre (BDAC), Attorney General’s Office (AGC), Ministry of Development and Public Works Department (JKR). Private sector professionals from PUJA and the construction industry also participated in the seminar and discussions.
